In most cases, a chapter 7 bankruptcy takes about four months to complete and for you to receive your discharge. During that time you will be under the protection of the automatic stay which prevents any of your creditors from taking any action against you.

Chapter 13 (Reorganization) – In a chapter 13 case, you agree to pay back a certain amount of your debt over a period of three to five years through a “plan” filed with the court. The plan will require you to pay back some of your overdue debt, and will allow you to bring current past due mortgage and car payments. Chapter 13 allows you to keep your valuable property, especially your home and car, while bringing these debts current under the protection of the bankruptcy laws.
